Agreeing to these terms
These terms apply when you use this website or order from Douglas Cunha Domingos, Itapemirim, ES, Brazil (“we”, “us”). By using the site or placing an order, you agree to them and to our Shipping, Returns and Privacy policies.
You must be at least 18, or the age of majority where you live, to place an order. For now we only sell to customers in the contiguous US.
About the product
Nape is a comfort product and is not intended to diagnose, treat, cure or prevent any disease.
Use it as described on this site and in any instructions that come with it. Check with your doctor first if you're pregnant, have a pacemaker or other implanted device, or have a neck injury or condition. It's not for children, or for anyone who can't feel heat well, such as people with nerve damage or poor circulation. Don't use it on broken or irritated skin. Don't fall asleep with it running: switch it off and unplug it when you're done. Stop if anything feels uncomfortable.
We describe the product and show it in photos as accurately as we can. Colors can look slightly different on different screens.
Prices and orders
Prices are in US dollars. Sales tax is added at checkout where it applies.
Buying 2 or more pillows? The multi-pillow price of $74.50 each is applied automatically at checkout.
We may cancel an order before it ships and refund it in full if the item is unavailable, if there's an obvious error in the price or description, or if we suspect fraud. We'll email you if that happens.
We may change prices or offers at any time. A change never affects an order you've already placed.
Payment
Checkout is handled by Shopify and card payments by Stripe. By paying, you confirm you're allowed to use the payment method you choose.
Shipping, returns and refunds
Delivery, the 30-night trial, returns and refunds are covered by our Shipping policy and Returns policy.
Using this website
Please don't misuse the site: no attempts to break or overload it, no large-scale scraping, and nothing unlawful. The text, photos and design on this site belong to us or to the people we license them from, so please don't copy them for commercial use without permission.
The site may link to other websites. We're not responsible for their content or practices.
Warranties
We stand behind the product as described in our Returns policy, and we don't offer a separate written warranty yet. Beyond that, and to the extent the law allows, the site and products are provided “as is”, without other warranties. Some states don't allow limits on implied warranties, so this may not apply to you.
Limits on our liability
To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability for any claim about an order is limited to what you paid for that order. Nothing in these terms limits liability that the law doesn't allow us to limit.
Disputes and governing law
If something goes wrong, please email torodandoblack@gmail.com first. Most problems are sorted out quickly that way.
These terms are governed by the laws of Brazil, where the seller is based, without regard to conflict-of-law rules. Nothing here takes away rights you have under the consumer laws of the state where you live.
Changes to these terms
We may update these terms. The version on this page when you place an order is the one that applies to that order.
